Terms & Conditions

1. Agreement

​

1.1    These Terms and Conditions ("Terms") form the entire agreement between you (the “Client” or “Traveler”) and Afkira Travels Inc. (“Afkira Travels,” “we,” “our,” or “us”) concerning all bookings, travel services, and transactions.

​

1.2    By booking a package/safari with Afkira Travels, submitting payment, or signing this agreement, you acknowledge and accept these Terms on behalf of yourself and all travelers in your party, including minors under your guardianship (each a “Traveler,” collectively the “Travelers”), and authorize Afkira Travels to make arrangements on their behalf.

2. Responsibility and Third-Party Suppliers

​

2.1    Afkira Travels arranges travel services in collaboration with independent third-party service providers ("Third-Party Suppliers") who deliver ground handling, transportation, accommodations, meals, guiding, and other services (“Travel Services”). These suppliers operate independently and are governed by their own terms, conditions, and liability limitations. Afkira Travels is not liable for the acts, errors, or omissions of these suppliers.

3. Reservations and Payment

​

3.1    Afkira Travels creates personalized itineraries based on client preferences and extensive destination knowledge. While we strive to match your travel goals, we cannot guarantee outcomes due to variables such as environmental conditions or third-party performance.

​

3.2    A non-refundable 30% deposit is required to confirm bookings made more than 90 days before the tour’s start date. Failure to remit the deposit by the stated due date may result in loss of the reservation. Confirmation is issued upon written acknowledgment of the deposit.

Note: Gorilla/chimpanzee permits and similar permits are billed separately and must be paid in full at the time of booking.

3.3    The remaining balance is due no later than 90 days before the safari begins. Non-payment by the due date may result in cancellation and forfeiture of the deposit. Late payments may incur a 5% surcharge.

3.4    For bookings made within 90 days of departure, 100% of the total cost is required to confirm the reservation.

​

3.5    Certain fees (e.g., national park fees, conservation levies, departure taxes, and permit fees) may need to be paid locally in cash unless specified as included.

​

3.6    All bookings are contingent upon the signing and return of:

  • The Booking Terms & Conditions

  • The Liability Release, Assumption of Risk, and Indemnity Agreement

 

3.7    Accepted forms of payment: check, wire transfer, or credit/debit card.

​

3.8    Chargeback Policy: You agree not to initiate a chargeback without first allowing Afkira Travels to address and resolve your concern. Filing a chargeback to circumvent cancellation/refund terms constitutes a breach of agreement. If a chargeback is initiated and Afkira Travels prevails, you agree to reimburse all legal fees and costs incurred in disputing the claim.

3.9    If your safari cost is quoted in United States Dollars (USD), South African Rand (ZAR), Namibian Dollar (NAD), or Euro (EUR), the conversion rate used will be the prevailing bank selling rate on the invoice date, as determined by Afkira Travels.

​

4. Tour Prices
 

Unless expressly stated in your final itinerary or quotation, the tour price does not include the following:

  • Visa, passport, and vaccination costs

  • International flights and departure/airport/airline taxes

  • Additional meals and activities not listed in the itinerary

  • Premium beverages including fine wines and champagne

  • Laundry, postage, personal items, and medical expenses

  • Emergency evacuation costs

  • Gratuities and excess baggage fees

  • Travel insurance

 

Afkira Travels is not responsible for any errors or omissions in quotes, itineraries, or marketing materials caused by incorrect information provided by third parties.

5. Cancellations, Postponements & Refunds

​

5.1 Cancellations

All cancellations must be submitted in writing via email and are effective only upon written acknowledgment by Afkira Travels.

​

5.2 Cancellation Policy

Cancellation charges are applied as follows:

Any non-refundable deposits paid to the hotels or airline tickets purchased, with prior notification to the client or agent will not be refunded

 

Where no such deposits have been made, the below applies:

Cancellation prior to 60/90 days (depending with season) – only bank charges will be deducted

Cancellations received less than 60/90 days prior to departure will be subject to the following

 

CANCELLATION FEES

​

Low Season:

Less than 60 days 25%;

Less than 45 days is 50%;

Less than 15 days is 100%;

Beyond 60 days – Full refund except bank charges (including service fees) and non-refundable deposits (if any) at the hotels and air tickets

Peak Season:

Less than 90 days 25%;

Less than 45 days is 50%;

Less than 30 days is 100%;

Beyond 90 days – Full refund except bank charges (including service fees) and non-refundable deposits (if any) at the hotels and air ticketsThese policies reflect our obligation to make advance non-refundable payments to our partners and suppliers.

​

5.3 Partial Tour Participation

No refunds will be issued for any portion of the tour not used once the trip has commenced, regardless of the reason for early departure.

​

5.4 Modifications

Requests to modify a confirmed booking must be submitted in writing. Approval is at Afkira Travels’ sole discretion. Administrative changes may incur a fee of up to $300 per traveler, depending on the nature of the change. Major changes, such as date shifts, may be treated as cancellations and subject to applicable cancellation fees.

5.5 Non-Refundable Circumstances

No refunds will be provided for:

  • Missed travel time or voluntary itinerary changes

  • Itinerary adjustments after departure

  • Events beyond Afkira Travels’ control or that of its partners, requiring alternative arrangements

  • Failure to notify Afkira Travels of a no-show for services or segments

  • Delays causing missed segments (e.g., flights, visa issues)

  • Departure after tour commencement

  • Illness, injury, pandemic-related restrictions, visa denial, loss of documents, or quarantine-related interruptions

 

5.6 Refund Processing

Any approved refunds will require a minimum of 45 days to process.

 

5.7 No Exceptions

No exceptions to this policy will be made for events including, but not limited to:

  • Weather-related disruptions

  • Acts of terrorism or civil unrest

  • Airline or service provider defaults

  • Strikes

  • Personal, family, or medical emergencies

  • Government travel advisories (including those from the U.S. State Department or WHO)

 

We strongly recommend purchasing comprehensive travel insurance, including “cancel for any reason” coverage, which must be secured shortly after making your initial deposit.

 

6. Third-Party Services and Provider Responsibility

​

6.1 Independent Suppliers

Afkira Travels acts as a booking intermediary for accommodations, airlines, charter flights, ground transportation, guides, boats, and other services provided by independent contractors (“Third Party Suppliers”). While we carefully select our partners and strive to recommend reputable providers, you acknowledge that these Third Party Suppliers operate independently and are not agents, employees, or affiliates of Afkira Travels.

Services arranged through Third Party Suppliers are subject to their individual terms and conditions, as outlined in their respective tickets, vouchers, or service agreements, and are also governed by the local laws and regulations of each destination. Afkira Travels is not liable for delays, cancellations, overbookings, strikes, or any negligent or intentional acts or omissions by Third Party Suppliers or their representatives.

6.2 Itinerary Adjustments

Afkira Travels reserves the right to make changes to the itinerary—including modifications, substitutions, or cancellations of specific segments—if deemed necessary for safety, operational feasibility, or unforeseen circumstances. Such changes do not constitute a breach of contract and do not entitle the traveller to compensation.

 

7. Changes and Cancellations by Afkira Travels

​

Should it become necessary for Afkira Travels to modify a confirmed itinerary—due to either Force Majeure or non-Force Majeure factors—we may, at our discretion:

a) Offer a revised or rescheduled itinerary; or
b) Propose an alternative travel experience.

In these cases, the traveller may select either option; however, no refund, compensation, or reimbursement will be provided for changes made, nor will Afkira Travels be held liable for any resulting costs or losses. These changes are not considered cancellations but rather itinerary adjustments or postponements.

If Afkira Travels must cancel your trip entirely and neither Option a nor b above is offered, we may, at our sole discretion, provide a refund less:

  • Airline cancellation penalties

  • Non-refundable deposits already paid to suppliers

  • Any applicable third-party cancellation fees

  • An administrative fee of $500 per traveller

Please note: Once deductions are applied, there may be no remaining funds to refund. The administration fee covers the substantial effort involved in trip design, coordination, and supplier arrangements.

We also reserve the right to cancel any tour due to insufficient group participation on fixed departures (not related to Force Majeure). In this rare case, a full refund will be issued for the travel portion. However, Afkira Travels is not liable for any additional costs incurred by travellers, including airfare, visa expenses, or non-refundable purchases. As such, we highly recommend securing comprehensive travel insurance—including “cancel for any reason” coverage—immediately after booking.

8. Assumption of Risk

​

8.1 Travel Risks

Travel to and within Africa involves inherent risks, including but not limited to illness, injury, accidents, unpredictable wildlife behavior, challenging terrain, and medical limitations in remote locations. By booking travel through Afkira Travels, you acknowledge and accept these risks as an integral part of the travel experience.

8.2 Medical Fitness

It is the traveller’s sole responsibility to consult a qualified medical professional before departure to ensure they are fit and adequately prepared for the physical demands of the tour. Afkira Travels shall not be held liable for any health-related issues, injuries, or fatalities sustained during travel, regardless of whether caused directly or indirectly through participation in any part of the itinerary.

 

9. Force Majeure

9.1 Definition

“Force Majeure” refers to any event or circumstance beyond the reasonable control of Afkira Travels, including but not limited to natural disasters (such as fires, floods, earthquakes, storms), war or threat of war, civil unrest, terrorism or threat thereof, labour disputes, pandemics, epidemics, government restrictions or interventions, acts of God, supplier insolvency, criminal acts, quarantine measures, weather-related disruptions, or other unforeseen or extraordinary circumstances.

 

9.2 Limitation of Liability

In the event of Force Majeure, Afkira Travels shall not be deemed in breach of these Terms and Conditions, nor shall it be liable for any failure or delay in the performance of its obligations. This includes the inability to provide travel services, modifications to itineraries, or cancellations that may result.

 

9.3 Rights and Refunds

If your confirmed travel is impacted by Force Majeure, Afkira Travels reserves the right to cancel or modify any portion of the itinerary at its sole discretion. While we will make every effort to recover funds from third-party suppliers, we cannot guarantee any refunds. Any refunds secured will be issued less non-recoverable supplier costs and a $500 administrative fee per traveller. Because many of our suppliers are based outside India, their refund policies—particularly in Force Majeure situations—may be inflexible or non-negotiable.

Please note that Force Majeure-related cancellations initiated by travellers will be subject to our standard cancellation policy outlined in Section 5.

 

9.4 Civil Unrest

If civil unrest arises in any destination, Afkira Travels will assess the situation and, based on reasonable investigation, determine whether travel may safely proceed. If we decide it is safe to do so, no refunds will be issued for cancellations. In this case, our standard terms (Section 5) will continue to apply.

 

9.5 Substitutions

Afkira Travels reserves the right to substitute accommodations, vessels, transportation, or attractions with similar alternatives when circumstances beyond our control or traveller safety require such changes.

 

10. Insurance and Medical Requirements

​

10.1 Mandatory Insurance

Afkira Travels requires all travellers to obtain the following types of insurance coverage prior to travel:

  • Emergency medical evacuation

  • Accidental death and disability

 

10.2 Strongly Recommended Coverage

In addition, we strongly recommend that you also purchase:

  • Trip cancellation and interruption insurance

  • Comprehensive medical coverage

  • Coverage for loss, theft, or damage to personal belongings

 

10.3 Traveller Responsibility

It is the traveller’s responsibility to ensure that adequate coverage is in place prior to travel. Afkira Travels must receive proof of insurance coverage at the time of final reservation confirmation. We are not responsible for refunding any travel insurance premiums under any circumstances.

 

10.4 Medical Assistance Disclaimer

While Afkira Travels and its local partners—including camps, guides, and staff—may assist in emergencies, they are not medically qualified to diagnose, treat, or advise on health issues. Travelers acknowledge that they are solely responsible for any medical costs, treatments, or evacuations incurred during travel. Afkira Travels and its affiliates are not liable for delays in medical attention or the consequences of such delays.

11. Surcharges

​

While Afkira Travels makes every effort to provide accurate and inclusive pricing, we reserve the right to apply surcharges in the event of unforeseen increases in governmental taxes, park and conservancy fees, permit charges, or airfare adjustments. Should a surcharge become necessary, we will notify you in writing as soon as reasonably possible. If payment is not received by the specified due date, your booking may be considered cancelled, and our standard cancellation policy (as outlined in Section 5) will apply. Any refunds issued will be at the sole discretion of Afkira Travels.

 

12. Booking Terms and Conditions

​

All travel arrangements are governed exclusively by these Booking Terms and Conditions and the accompanying Liability Release, Assumption of Risk, and Indemnity Agreement (together referred to as the “Trip Terms”). These documents represent the full and final agreement between Afkira Travels and the traveller, superseding any prior communications or representations. No modifications shall be binding unless confirmed in writing by an authorized officer of Afkira Travels.

13. Transportation by Land, Sea, and Air

​

13.1 General Conditions

All travel services provided by land, sea, or air are subject to the terms and conditions of the individual carriers, as well as applicable international conventions, some of which may limit the carrier’s liability. Travel disruptions due to the operational decisions of airlines, airports, or ports—including cancellations, delays, or diversions—are beyond the control of Afkira Travels. Accordingly, Afkira Travels assumes no responsibility or liability for such occurrences.

13.2 Flights and Charter Arrangements

Air travel will typically be arranged through recognized domestic and international airlines or reputable charter companies. You may be asked to sign additional waivers or indemnity agreements with those operators. Afkira Travels is not a party to, and cannot be held liable under, any contract or agreement between the traveller and an airline or charter company, even when flight arrangements are made on your behalf.

14. Baggage

​

Loss, delay, or damage to baggage and personal effects is the sole responsibility of the traveller or the carrier involved. Afkira Travels accepts no liability for any lost, misplaced, delayed, or damaged baggage. We strongly recommend obtaining travel insurance that includes coverage for personal belongings and baggage.

​

15. Travel Documents and Vaccinations

​

It is your sole responsibility to ensure that all travel documentation is accurate, up to date, and valid for entry into your chosen destination(s). This includes passports, visas, travel permits, vaccination records, health certificates, international driver’s licenses, and any other necessary paperwork. Afkira Travels will not be liable for any costs, losses, or damages resulting from incomplete, expired, or incorrect documentation. Because regulations may change without notice, it is the traveller’s responsibility to verify requirements with the appropriate authorities prior to departure.

 

16. Special Requests

​

Any special requests, including dietary restrictions, mobility assistance, or room preferences, must be communicated to Afkira Travels in writing at the time of booking. While we will make reasonable efforts to accommodate such requests, fulfilment cannot be guaranteed and is subject to availability and the policies of our third-party partners.

​

17. Dispute Resolution

​

If you encounter any issues during your journey, you must report them in writing to Afkira Travels’ local representative and the ground operator immediately, so they may attempt to resolve the situation promptly. Failure to do so while on tour may limit or forfeit your right to seek any compensation from Afkira Travels. Post-trip complaints must be submitted in writing within 30 days of your tour’s completion. Attempting to resolve the issue independently without notifying Afkira Travels may affect your eligibility for refunds or reimbursement.

18. Consent

​

Payment of a deposit or any portion thereof confirms your acceptance of all terms and conditions provided by Afkira Travels, including those related to your booking and the information shared with you. These terms cannot be modified unless in writing and signed by an authorized representative of Afkira Travels.

​

19. Payments via Booking Agents

​

If your reservation is made through a third-party travel agent, that agent will transmit your payments to Afkira Travels on your behalf. However, until we issue a Booking Confirmation, Afkira Travels accepts no liability for funds paid to a third party. We will confirm receipt of payment directly to your agent upon receiving funds.

​

20. Participation Requirements

​

All travellers are expected to comply with the guidance of Afkira Travels’ staff and local operators at all times. Afkira Travels reserves the right to refuse participation or remove a traveller from a tour, without refund, if deemed unfit due to medical, physical, or behavioral reasons that pose a risk to themselves, other travellers, or staff, or which significantly disrupt the tour experience. Afkira Travels is not responsible for any additional costs incurred by such removal.

21. Severability

​

If any provision of these terms is deemed unenforceable or invalid under applicable law, the remaining provisions shall remain in full force. Any invalid term shall be replaced by a legally enforceable provision that most closely reflects the original intent.

​

22. Notice of Enforceability

​

By confirming a booking with Afkira Travels, you enter into a binding legal agreement, acknowledging that you have read, understood, and agreed to all terms outlined in this document.

 

23. Updates to Terms

​

Afkira Travels reserves the right to amend these Terms and Conditions at any time, including due to Force Majeure or other legal or operational reasons. Any updates will be posted at www.afkiratravels.com/terms-and-conditions. Continued use of our services or participation in a tour implies acceptance of any updates.

​

24. Compliance with Local Laws and Tour Etiquette

​

Travelers must adhere to all local laws, customs, and health regulations while on tour. Respect for fellow participants, local culture, and your guide's instructions is expected. The guide’s decision is final on all matters impacting safety and the quality of the group experience.

​

25. Privacy Policy

​

By agreeing to these Terms, you also accept the Afkira Travels Privacy Policy outlining how your data is collected, used, and protected.

​

26. Disclaimer of Warranties and Limitation of Liability

​

While Afkira Travels makes every effort to ensure the accuracy of the information provided, travellers are responsible for independently verifying any details relevant to their tour. Afkira Travels disclaims all warranties, express or implied, and limits liability to the fullest extent permissible under law.

 

27. Successors and Assigns

​

This Agreement shall be binding upon and inure to the benefit of Afkira Travels, the Traveller, and their respective heirs, legal representatives, successors, and assigns.

​

28. Entire Agreement (Merger Clause)

​

This Agreement constitutes the entire, final, and exclusive understanding between the parties with respect to the subject matter herein. It supersedes all prior discussions, negotiations, agreements, or understandings—whether oral or written. No other promises, terms, or conditions shall be binding unless expressly agreed to in writing by Afkira Travels.

 

Acknowledgment and Signature

​

I confirm that I have read this entire agreement and understand its content. I am signing it voluntarily, with the full understanding that it constitutes a legally binding contract, whether executed electronically or in physical form. No verbal or written representations, other than those contained herein, have been made to me regarding the legal effect of this document. My signature below applies to all pages of this agreement.
